Three car owners in California filed a lawsuit against Tesla Inc. on Wednesday, alleging that Tesla falsely advertised and inflated the estimated range of its electric cars.

Tesla accused of inflating mileage

The three Tesla owners filed the lawsuit in the U.S. District Court for the Northern District of California and are seeking to escalate the case into a class action lawsuit against Tesla on behalf of all California owners who have purchased the new Model 3, Model S, Model Y, and Model X in the hopes of obtaining damages for an undisclosed amount.

The lawsuit cites a Reuters report from last week. According to the report, Tesla CEO Elon Musk personally ordered an “optimistic” range estimate for the cars to entice customers to buy them. However, due to a large number of complaints from owners about the range, resulting in overcrowded service centers, Tesla created a “complaint diversion team” in Nevada to minimize the number of range-related appointments. Tesla and Musk have not yet responded to the report.

The lawsuit alleges that Tesla violated the terms of its car warranty and committed fraud and unfair competition. “Simply put, Tesla had a duty to deliver a product that performed as advertised.” Adam Edwards, an attorney with Milberg Coleman Bryson Phillips Grossman, the law firm representing Tesla owners, said in a statement.

The three plaintiffs cited scenarios in which their Tesla cars didn’t have the advertised range and said they had complained to Tesla without success. One of the plaintiffs is James Porter, a Model Y owner in Petaluma, California. Porter cited a trip where he drove only 92 miles, but the range “dropped by about 182 miles,” he said.

“If Tesla had been honest about the range of its electric vehicles, consumers either would not have purchased Tesla’s Model models or would have simply paid less for them.” The lawsuit claims.

On top of that, Tesla has faced lawsuits and regulatory scrutiny over its Automated Assisted Driving (Autopilot) and Fully Self-Driving (FSD) systems and its promotion of the safety of those systems. In April, Reuters reported that Tesla employees shared sensitive images and videos taken by the car’s cameras on an internal information system. As a result, a California Tesla owner accused Tesla of violating customer privacy and was ready to escalate the case into a class action lawsuit. Tesla has denied the allegations.

Tesla, Musk have yet to comment on the lawsuit.

Morgan Stanley analyst Adam Jonas recently made a judgment, saying Tesla’s super-charging station network will bring Tesla more than 100 billion dollars of huge value.

It is noted that Jonas is one of Morgan Stanley’s top Tesla analysts. He and his team first hypothesized that Tesla could produce and store its own solar power to power its supercharging stations.

Based on this hypothesis, Jonas’ team estimated the value of Tesla’s supercharging network in several ways and dimensions. These include:

Electric vehicle miles traveled in the U.S. in 2030

Market share of Superchargers powering those miles

Average efficiency of 4 miles per kWh of electricity driven

A price of $0.32 per kilowatt-hour of electricity

The Jonas team then estimated the value of the Supercharger network under different scenarios, using a 20x FY 2030 after-tax net operating profit and a 9.0% weighted average cost of capital, and valued the Tesla Supercharger network under different scenarios:

"plausible case": assuming 10% EV mileage penetration, 50% market share of Tesla Superchargers, and a 30% net operating profit after tax (NOPAT) margin, the potential net present value of Tesla's Supercharger business is $3 per share

"Credible Case: Assuming 20% EV mileage penetration, 70% market share of Tesla's hyperchargers, and 50% NOPAT, the potential NPV of the business is $14 per share

"Dominant Case": Assuming 30% EV mileage penetration, 80% share of Tesla Superchargers, and 70% NOPAT, the potential NPV of the business is $33 per share

"Monopoly Case": Assuming 50% EV mileage penetration, 100% share of Tesla Superchargers, and 80% NOPAT, the potential NPV of the business is $78 per share

Since Tesla holds over 3 billion shares outstanding, at $33 per share, the entire Supercharger network would have a maximum estimated value of over $100 billion.

Currently, the Tesla Supercharger Network is the only global fast-charging network for electric vehicles, with automotive giants such as GM and Ford set to join the Tesla NACS charging interface standard, and the number of automakers showing interest in the standard is growing.

Tesla has been cutting prices frequently lately, but this time not for its electric cars, but for its exclusive DC fast charging network. Tesla has now lowered its supercharger station fees in most European markets, which is good news for Tesla and other electric car owners.

One of the biggest advantages of electric cars is that they are far less expensive to use than internal combustion engine cars, as electricity is usually much cheaper than gasoline, but this can also be affected by fluctuating electricity prices. electricity prices in Europe have fluctuated dramatically over the past year, and Tesla had to significantly increase the price of charging at Supercharger stations last September in response to rising electricity prices, but electricity prices in Europe have come down.

Now Tesla has decided to lower the price of Superchargers, and the price reduction was implemented today in almost all European markets. Charging prices have dropped between 10 and 20% in most markets, and in some, such as Spain, prices have even dropped by 25i%.

It is worth noting that this does not only affect Tesla owners, many European Superchargers are already open to all non-Tesla electric cars, so these owners can benefit as well.

Norway has a relatively small population of only 5.425 million people, ranking 118th in terms of population and 61st in terms of land area, but Norway is one of the most vigorous countries in Europe in terms of transition to the new energy field. The land area and population are quite exaggerated.

In September of this year, Norway’s electric vehicle penetration rate had risen to 25%, which means that at least a quarter of new cars are electric vehicles, so various electric vehicles and manufacturers are adding bricks and tiles to the country’s new energy infrastructure. Currently, there are more than 1,500 Superchargers in Norway.

Among the newly registered electric vehicles in the country, Tesla was the best performer. As of 2022, Tesla’s sales will be 18,425, accounting for 15.5% of the annual electric vehicle sales, followed by 14,965 and 12.5% of Volkswagen, followed by BMW (8.3%) and Audi (7.1%) and Hyundai (6.3%).

The Tesla Model Y is the best-selling model in the Norwegian market, with sales of 15,289 units so far this year, so Tesla has expanded its EV supercharging pilot program to Norway, allowing owners of other brands of electric vehicles to use the company’s super charger.

Tesla’s super charging station pilot program has expanded to 15 European countries, allowing non-Tesla owners to charge at a certain rate. Rates vary by site and can be reduced by becoming a member, the company said.

In the past, it cost more than $5 (about 36 CNY) or $10 (about 72 CNY) to fully charge at a Tesla supercharging station.

A Tesla owner said via Twitter that Tesla should have reduced the cost of supercharging stations throughout Los Angeles and parts of California by 5 cents (about 0.36 CNY) per kilowatt-hour.

In addition, Elektrek noted that prices in parts of Europe have fallen by as much as 10 cents per kWh.

Tesla announced on November 23 that it has built and opened 40,000 supercharging stations around the world, and has the world’s largest DC fast charging network.

Tesla sent an email to European owners warning that the price of charging on its supercharger network would rise sharply again, according to Electrek. In the email, Tesla blamed the price hike on rising “energy prices” in Europe. According to the media check, charging prices have increased by an average of 0.12 euros per kilowatt hour.

One of the biggest advantages of electric vehicles remains their much lower operating costs than internal combustion engine vehicles, thanks to the fact that electricity is usually much cheaper than natural gas. However, due to the war in Ukraine and Russian oil and gas restrictions, the cost of gas and electricity has been soaring, especially in Europe.

In the past, a full charge at a Tesla Supercharger station typically cost no more than $5 or $10. After several price increases, many Superchargers are now charging $0.50 per kilowatt hour, which could result in a cost of $30 for a 60-kilowatt hour charge.

After this latest price increase, Supercharging prices will be higher than €0.60 per kWh at most charging stations in Europe. In most cases, however, these prices are still cheaper than gas, which has also risen significantly in the last year.

This is because, as these prices only apply to superchargers, this represents only a small part of the overall charging for most electric car drivers, as most charging usually takes place at home during overnight stays.

Overall, electricity rates have also been rising, but they are more manageable than those for Superchargers, which are also subject to demand charges.

Tesla is expected to increasingly invest in solar and storage for Supercharger stations to help control energy costs and ultimately Supercharger prices.

Tesla may be waiting for Supercharger V4 to allow for wider deployment of solar and storage at charging stations.
