Xpeng Auto was fined $3,000 for not changing terms of agreement

August 11, the information shows that recently, Xpeng car sales service limited company for violation of consumer rights protection management regulations, by Suzhou high-tech zone (huqiu district) market supervision administration fined 3000 yuan.

The reason for the fine is that the company used a purchase agreement that was developed by Guangzhou Xpeng headquarters and embedded in Xpeng’s official app in the process of selling cars. The agreement stated that “if the parties do not reach a consensus to resolve such disputes, either party shall have the right to submit the dispute to the Guangzhou Arbitration Commission for arbitration” and that consumers were required to use the Xpeng Auto App to sign the purchase agreement when purchasing Xpeng vehicles and that the terms of the agreement could not be changed. The parties rectified the terms of the above agreement in April 2022.

In April this year, the National Enterprise Credit Information Public Notice System showed that Beijing Xpeng Automobile Sales & Service Co., Ltd. was warned and fined $3,000 by the Beijing Chaoyang District Market Supervision Administration for providing unfair contract terms that infringed on consumers’ rights.
