Tesla takes action against those who resell Cybertruck: cancels other pre-orders

Tesla is making good on its previous threat to some early reservation holders of the Cybertruck electric pickup truck for profit.

In order to prevent buyers from profiting from speculation, Tesla added a “no resale” clause for some early VIN Cybertruck vehicles before the order was confirmed, and threatened violators to face US$50,000 (Note: currently about 359,000 US dollars) A fine of RMB (RMB) or more may be imposed, and his or her subsequent Tesla car purchase qualifications may be cancelled.

However, the enforceability of this provision is questionable. On the one hand, consumers have the right to dispose of their own property, and resale for profit is also legal; on the other hand, Tesla also has the right to choose who to do business with.

As expected, a few Cybertrucks showed up at auction and fetched over $200,000, with even Ford buying one, presumably for reverse engineering research.

Recently, a car owner who resold his Cybertruck posted that Tesla contacted him and canceled his pre-orders for two other Cybertrucks. The owner said: “Tesla’s property damage prevention department flagged me and the store supervisor contacted me. I said they canceled my other reservations.” Tesla refunded the $100 reservation deposit for each order, but also informed him that he would no longer be able to make future reservations.

At least Tesla didn’t actually sue him for $50,000.
