Google confirmed to the court that Epic had received an agreement worth US$147 million to put its popular game “Fortnite” on the Google Play Store.

Purnima Kochikar, vice president of partnerships at Google Play, said the deal was approved and submitted to Epic, but not accepted.

Epic will receive the money in phases under the three-year “incremental funding” plan, which runs through 2021. The agreement is designed to prevent popular apps from bypassing Google’s cut.

In fact, Epic made the Android version of Fortnite available directly through its official website in 2018, bypassing the Play Store and eliminating the need to pay Google the Play Store commission. In an antitrust lawsuit filed later in 2020, Epic said the decision briefly sent Google into panic.

Citing internal documents, it said Google was concerned that this approach could have “contagion risks,” meaning other game developers (including Blizzard, Valve, Sony, and Nintendo) would follow Epic’s lead.

Epic also claims that Google tried to prevent this from happening by offering special benefits or even acquiring Epic.

Lawrence Koh, the departed head of Google Play games business development, testified in court on Tuesday that these “contagious” documents were submitted to the court.

Google believes that almost all leading game developers are considering withdrawing from the Play Store after seeing Epic’s move, which may cause Google to lose billions of dollars in revenue.

Court documents predict that if “Fortnite” leads to a subsequent large-scale “evacuation”, it may cause Google to suffer a direct revenue loss of 130 to 250 million US dollars. There may also be indirect losses of up to US$3.6 billion.

Google said it was just concerned about the loss of games on the Play Store and had no malicious intent. “We just want developers to choose Play,” Koh said. “We think getting games on the service is a worthwhile investment.”

The popular game “Fortnite” will undergo an internal age rating, a move aimed at protecting players from accessing inappropriate content.

Epic has partnered with the International Age Rating Alliance (IARC) to launch a new system that will apply to all first- and third-party playable content starting November 14, 2023.

According to reports, to obtain an age rating, creators need to fill out the IARC content rating questionnaire, which will then be reviewed by Epic. After that, they can obtain ratings from IARC participating rating agencies, including ESRB (North America), PEGI (Europe) and ACB (Australia). Region-specific ratings, ranging from E to the highest Teen rating.

The IARC questionnaire will be available on the Creator Portal starting October 16th. Any islands that have not been rated before November 14th will be cleared. Epic says the IARC-assigned rating (from E to Teen) will be highlighted before entering the island.

Additionally, once the new ratings go live, new parental control options will allow users to set content age-rating restrictions, blocking access to islands above certain classifications.

The Olympic e-sports series is a global virtual and simulated sports competition held by the International Olympic Committee in cooperation with the International Federation (IF) and game publishers. Epic Games boss Tim Sweeney said that he is not a big fan of traditional advertising and prefers to use the form of brand cooperation in “Fortnite” marketing, such as themed cosmetics and branded concerts. “The best moment in Fortnite is when other brands enter the world of Fortnite — a fashion house, Ferrari enters the world, Marvel and Star Wars crossover,” Sweeney said in an interview with Digiday.

He concludes: “I think brand presence is a healthier way for companies to engage with the Metaverse than advertising. Playing ads is annoying. Players hate it and they don’t pay much attention to the content – however, give them a driveable Ferrari Or a cool shirt they can wear and they’ll love it.”

With “Fortnite” making waves for its high-profile crossovers with musical acts, anime, movies and other video games, Sweeney prefers brands and companies from a collaborative perspective rather than traditional “billboards.”

When it comes to in-game monetization opportunities, both Sweeney and executive vice president Saxs Persson are cautious. Persson said direct virtual commerce would only happen if players might be interested, but “that’s not in the plan” right now.

“It depends a lot on what they’re selling. If you’re selling a ticket to a great experience, then that’s the whole model of the gaming business,” Sweeney said. However, Sweeney said Epic Games isn’t interested in including loot boxes in Fortnite or items that give players an advantage.

“We see Fortnite as an opportunity to build a better world, a world away from the competition that exists in the mobile gaming market today,” Sweeney said. “The key problem with the mobile ecosystem is that user acquisition is entirely advertising-based, and those who use The companies with the worst consumer behavior for pay to win and loot boxes make the most money from consumers so they are able to bid the highest ads. Epic Games CEO Tim Sweeney hinted that “Fortnite” will return to iOS and iPadOS in 2023.

Epic has been taken off the App Store by Apple since August 2020 after violating the rules of Apple’s payment system, which led to Epic filing a lawsuit against Apple. In a tweet marking the New Year, Tim Sweeney seemed to think progress would be made in 2023.

In a January 1 tweet, Sweeney posted a brief message, “Next year on iOS!” In his reply, Sweeney shared an image from the Fortnite game.

Sweeney did not give details, but speculation is that he was hinting that Fortnite will return to the App Store this year, however that would require a major settlement between Apple and Epic. Given that the lawsuit’s appeal process is still ongoing, that could take some time to complete.

In a December interview, Sweeney said he would fight Apple to the Supreme Court if that’s what it takes to get a victory, saying, “We’ll keep fighting as long as we can get what we’re asking for. If Apple would settle for that, we would settle today.”

It’s also possible that Epic will make an iOS app store of its own. That’s because in Europe, the Digital Marketplace Act would force Apple to allow third-party app marketplaces to exist on the iPhone and iPad. If Apple has no objections, the law could lead to Apple enabling the feature in the fall of 2023, though Apple’s resistance could push the change to 2024.

However, reports surfaced on December 13 that Apple is already making changes to its software and services to comply with the rules, including enabling third-party app stores without going through the App Store itself.

In December, Sweeney continued to bash Apple and its policies under the guise of being anti-competitive, comparing Apple’s management of the App Store to a railroad monopolist blocking refineries from using the infrastructure.
