Apple’s attempt to overturn Colombia’s 5G iPhone, iPad sales ban fails again

Apple’s second attempt to overturn Colombia’s 5G iPhone and iPad sales ban ended in failure as the Colombian court rejected Apple’s petition, according to a report by Foss Patents, a leading foreign intellectual property blog.

The first attempt was an emergency motion Apple filed with a U.S. federal court in Texas, in which Apple sought damages from Ericsson for any losses it incurred as a result of the Colombian court’s ban, though the request was denied by the court.

In April, a Colombian court reportedly ruled that Apple infringed on one of Ericsson’s 5G patents, and Ericsson subsequently filed a $50,000 bond to allow the court to enforce the law, which in July issued a preliminary injunction against Apple’s Colombian subsidiary, prohibiting the sale and import of Apple’s 5G devices, the iPhone and iPad, in the country.

The dispute between Ericsson and Apple has unfolded globally, with Ericsson statistically having filed patent infringement lawsuits against Apple in at least six jurisdictions, including the United States (ITC and district courts), Germany, the Netherlands, Brazil, Colombia and the United Kingdom, over the failure of negotiations to renew a seven-year telecommunications patent licensing contract first agreed to by the two parties in 2015.
