According to Reuters, the U.S. International Trade Commission (ITC) issued the latest ban, which may prohibit Apple from importing Apple Watch series products in the United States.
The new injunction upholds a January ruling that Apple’s Apple Watch technology that reads blood oxygen levels infringes Masimo’s patent.
However, this new ban does not take effect immediately. Instead, it will be submitted to the current US President’s staff team for review. There will be 60 days to confirm whether to approve the ban based on policy. After the 60-day review period, Apple can appeal the ban to the U.S. Court of Appeals for the Federal Circuit.
An Apple spokesperson responded as follows: “Masimo is wrongly trying to use the ITC to prevent millions of American consumers from purchasing a potentially life-saving product while marketing its own copycat Apple Watch. Although today’s decision will not be immediate, There will be an impact on Apple Watch sales, but we believe this decision should be overturned and will continue to work hard to appeal.”
Masimo CEO Joe Kiani said the decision “sends a powerful message that even the world’s largest companies are not above the law.”
