The instrument shows that the plaintiff Beijing Muhua company claims that it enjoys the exclusive network dissemination rights of the course “Financial Analysis and Decision Making” taught by Professor Xiao Xing of Tsinghua University, and the defendant’s website continues to provide playback services for infringing videos for a long time, and does not delete or block infringing videos, which constitutes abetting infringement and helping infringement.
The defendant Shanghai Wide Entertainment argued that as a network service provider, it provided information storage space services for registered users and had no legal obligation to review in advance, and the existing evidence could not prove that the video in question could be played.
The court heard that the defendant did not exercise reasonable care for the videos released by the users involved, let the relevant videos spread, and recommended, constituting abetting and aiding infringement, infringing the plaintiff’s right to information network dissemination of the videos involved. In the end, the court ruled that the defendant should compensate the plaintiff for economic losses and reasonable expenses totaling more than 440,000 yuan.
