Porsche recently applied to register the sound of its electric vehicles as a trademark in Europe, but was rejected by the European Intellectual Property Office (EUIPO) on the grounds that the sound was not unique enough.
Porsche says its electric vehicle sounds are futuristic, melodic, rhythmic and dynamic, and can remind consumers of the Porsche brand. Porsche has also compared the sound of its electric cars to Beethoven’s Fifth Symphony, the KITT scanner in “Knight Rider” and the lightsaber sound in “Star Wars.”
EUIPO believes that the sound of Porsche’s electric vehicles only imitates the sound of an internal combustion engine accelerating to reach a target speed and that this sound does not allow consumers to distinguish Porsche from other brands’ products. EUIPO also pointed out that the sound of Porsche’s electric car is not a piece of music and cannot be compared with Beethoven’s symphony. EUIPO also stated that the voices in the film and television works cited by Porsche are no longer representative of today’s world.
It is understood that although EUIPO rejected Porsche’s trademark application, Porsche has appealed.
