Ministry of Transportation seeks public comments on the “Guidelines for Safety Services for Transportation of Autonomous Vehicles

IT House August 8, the Ministry of Transport today released a notice on the “self-driving car transportation safety service guidelines (for trial implementation)” (draft for public comment) for public comment.

In order to adapt to the development trend of autonomous driving technology, encourage and regulate the application of self-driving cars in the field of transport services, to ensure transport safety, the Department of Transport Services, based on a systematic review and summary of the pilot demonstration operation of self-driving cars, the organization drafted the “self-driving car transport safety service guide (for trial implementation)” (see annex), is now open to the public for comment.

IT House learned that the draft for public comments on self-driving car transportation of transport operators, vehicles, personnel and other requirements.

Scope of application.
The use of self-driving cars on roads (including highways), urban roads and other types of roads used for social motor vehicle traffic, engaged in urban public bus (electric) passenger transport, passenger transport for hire, road general cargo transportation, road passenger transport business activities, the application of this guide.

The self-driving car referred to in this guide is a car with the ability to perform all dynamic driving tasks under its design operating conditions, including conditional self-driving cars, highly self-driving cars and fully self-driving cars.

Development orientation.
Under the premise of ensuring transport safety, encourage the use of self-driving cars in scenarios such as closed bus rapid transit systems to engage in urban public bus (electric) passenger transport operations, in scenarios with simple traffic conditions and relatively controlled conditions to use self-driving cars to engage in passenger transport operations for hire cars, and in scenarios such as point-to-point trunk road transport, with relatively closed roads to use self-driving cars to engage in road general Cargo transportation business activities. Prudent use of self-driving cars engaged in road passenger transport business activities. Prohibit the use of self-driving vehicles engaged in road transport operations of dangerous goods.

Transport operator requirements.
The use of self-driving vehicles engaged in urban public bus (electric) passenger transport, passenger transport for hire, road general cargo transportation, road passenger transport operators (hereinafter referred to as transport operators) shall be registered as a market entity in accordance with the law, the scope of business should be registered in the appropriate business category. Engaged in taxi passenger transport, road general cargo transportation, road passenger transport operations should have the appropriate business category of road transport business license qualification. Engaged in urban public transport (electric) vehicle operation should be in line with the national and local city people’s government related to operational qualification requirements.

Vehicle requirements.
Engaged in the transport operation of the auto should be insured against compulsory motor vehicle traffic accident liability insurance, production safety liability insurance and insurance amount of not less than 5 million yuan of motor vehicle third-party liability insurance. Automated vehicles engaged in road passenger transport, network booking taxi passenger transport should also be insured in accordance with the relevant state provisions of the carrier liability insurance.

Personnel requirements.
Conditional self-driving and highly self-driving cars engaged in transport operations should be equipped with drivers, fully self-driving cars engaged in transport operations should be equipped with remote drivers or safety officers. Drivers and safety officers should be qualified by the transport operator training assessment, master the instructions for use of self-driving cars, familiar with the risk of self-driving car routes, with the ability to deal with emergencies. Drivers should also meet the regulations and requirements for the management of transport practitioners, to obtain the appropriate qualification certificate.

Transportation safety and security.
Transport operators in the development of transport safety and security program, should be clear self-driving car operating routes away from schools, hospitals, large supermarkets and other crowded places; in the rain, snow, ice and other bad weather, should stop using self-driving cars to engage in transport operations as required.

Vehicle dynamic monitoring.
Transport operators shall, in accordance with the “Road Transport Vehicle Dynamic Supervision and Management Measures” and relevant regulations, strengthen the dynamic monitoring of self-driving vehicles, monitoring and management of vehicle operating areas, operating routes, operating conditions, timely reminders to correct and deal with violations.

Operational status information management.
Autonomous vehicles engaged in transport operations should have vehicle operating status records, storage and transmission functions, timely transmission of relevant information to transport operators and local transport authorities. In the event of an accident or failure of the vehicle’s self-driving function, automatically record and store the operating status information for at least 90 seconds before the incident to at least 30 seconds after the incident. The operating status information includes at least: basic vehicle information, control mode changes, received remote control commands, operating status, human-machine interaction and interior and exterior images.
